Refund Policy

Digital Download PDF Products

Because of the nature of the digital download, I typically do not refund digital download products purchased from our shop. Please contact us at tracieannekiernan@gmail.com to address your concern with the product.  

 

Membership 

If you are not satisfied within 7 days of joining membership, you may request a refund if you did not access bonus material and/or download PDF files. Please contact us at tracieannekiernan@gmail.com to address your concern or situation.  

 

Membership Terms Of Service

Cancellation

You can cancel your membership anytime. The easiest way to cancel is to email me directly at: tracieannekiernan@gmail.com and I will reply promptly to your request.

You can also login to your account and cancel. To cancel, please visit this billing link and scroll down and click “Edit” under “Community” and then scroll down and click “Cancel Plan”.

You can also use the message feature in your membership portal and I will respond promptly to your message. You will get a confirmation of your cancellation. If you do not get a confirmation, please let me know and I can double check of this for you. 

PLEASE NOTE: if you click “delete my account” this WILL delete your account. That means you will not be able to log in anymore and access material until the end of your billing term. 

Recurring Payment

Some parts of the Service are billed on a subscription basis (hereinafter “Subscription”). If you order a Subscription to a Service you will be billed in advance on a recurring and periodic basis (hereinafter “Billing cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. This will recur on the day that you sign up and payment will be taken out unless you specifically choose to cancel your subscription. 

 

Deleting Account

If you wish to completely delete your account, you will need to go to your account page here and click “Delete Your Account”.  Please note that if you delete your account, you will loose access to all content, even content that you still have until the end of the next billing cycle. To prevent this, simply cancel your subscription instead of deleting your account. 

 

Upgrading or Downgrading

You may upgrade or downgrade your membership at anytime. To do so, please visit your account page and click edit next to “Community”, scroll down and click  “Change Plan”. You can also switch to an annual plan in this area. 

Additionally, you can email me or message me from the membership portal and I can guide you with how to do this! 

 

Accessing Bonus Content After Cancellation 

The “bonus exclusive tutorial library” is only available to active paid members. If you delete your account, you will no longer have access to this library. If you cancel your membership, this content will be available until the end of your billing cycle. Then, when your billing cycle is up, the “bonus exclusive tutorial library” will no longer be available. 

 

Accessing Downloadable Materials After Cancellation

Certain membership plans give you “all-access” to the entire download library. This is available to active paid members. Members are welcome to download material during their membership term. If you delete your account, you will no longer have access to the library of downloads. If you cancel your membership, the downloadable content will be available until the end of your billing cycle. When your billing cycle is up, the downloadable content will no longer be available. 

 

Emails During Membership

Communication for the membership is done through a “Weekly Wednesday Email”. Members get the new tutorial emailed to them every Wednesday. This email includes the full instructions and a link to login to your account to view the video. You can manage your email preferences here. This email is sent out to all active paid members. Upon cancellation, you will still receive this email until the end of your billing cycle. Unsubscribing from the email does NOT cancel membership. It is the member’s responsibility to login to account and cancel or email tracieannekiernan@gmail.com to request cancellation. 

 

NOT Logging Into Account & Recurring Payments 

Payments are set on a recurring basis regardless of login activity. NOT logging into your account does NOT cancel you from the membership. It is a member’s responsibility to request cancellation via email: tracieannekiernan@gmail.com or going to account settings and cancelling account. Clicking “unsubscribe” from the bottom of an email also does not cancel the recurring payment. 

 

Intellectual Property

The artwork and tutorials will remain the exclusive property of Tracie Kiernan. *The artwork & tutorials are protected by copyright and cannot be used for profitable purposes unless you are subscribed to a small business membership for designs plan. The artwork and tutorials may not be used in connection with a product or service without prior written consent of Tracie Kiernan. If you are a paint party business owner or someone that teaches students paintings and charges for classes, please join the small business membership to obtain non-exclusive rights. 

*The exception for this is that I allow you to sell individual paintings you did. You just cannot “mass produce” them 🙂 

 

Small Business Membership Terms

Terms are granted under the Step By Step Painting, LLC License Agreement Document. By subscribing to our membership, you agree to the terms of this agreement. Upon unsubscribing, you agree to stop using designs which are owned by Step By Step Painting, LLC. Step By Step Painting, LLC retains the right to ask you to remove copyrighted material if you are no longer a part of our small business membership. 

 

Subscriptions

Our membership is billed on a subscription basis. Billing cycles are set on a monthly basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Tracie Kiernan cancels it. You may cancel your Subscription renewal either through your billing page or by contacting Tracie Kiernan directly at: tracieannekiernan@gmail.com. 

A valid payment method is required to process the payment for your Subscription. By submitting such payment information, you automatically authorize Step By Step Painting to charge Subscription fees incurred through your account via Stripe our third party payment processor.

 

Accounts

You are responsible for safeguarding the password that you use to access the membership and for any activities or actions under your password, whether your password is with our membership or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. 

 

Misuse of Service & Termination Of Account 

We reserve the right to terminate your account and/or prevent you from signing up for the membership or any of the content in the future if we feel you are misusing or abusing the service in any way.

The purpose of this privacy policy is to inform you of what information we may collect and how it may be used.  This statement applies to this Website.

Voluntary Collection Of Information: 

Although completely optional, I may collect information from you such as your name and email address. This information is collected ONLY if you subscribe to my monthly newsletter, leave a comment or use the contact me form.

If you send a message via the contact me form, I do not store or distribute your email address. You will not be opted into future mailings. The email address you submit will only be used as a means to reply to your message.

Information entered via the “subscribe to my mailing list” form is stored by me via my in a third party mailing list platform called “MailChimp”. The information that is stored with Mail Chimp is not sold or shared with anyone and it is kept strictly private. If you enter information via comments, I will not distribute your email address or use it to opt you into my newsletter. Your IP address is stored privately if you submit a comment. I do not use or distribute your IP address. At anytime that you wish to have your comment removed along with any data associated with it, contact me right away.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. Any interaction on Social Media that may include personal information such as name, location, etc. is not directly stored by this website. For example: if you comment on a link, like a page, follow my profile, etc., I do not store any information regarding your name, profile or interaction. The Social Media sites have their own privacy policies and store that information in their platform.

Children and COPPA (Children Online Privacy Protection Act):  

This website is intended for adults but may have tutorials that are “kid friendly” with the guidance of an adult. I do encourage you to paint and create art with your child but please exercise caution. If your child is doing art from this website, adult supervision is required.  

Sharing your child’s art is not required or requested. Please do not disclose any personal information about your child like name, location, etc. I  do not recommend sharing your child’s art on Pinterest pins “upload photo” section as those are not monitored by me. If you have any concerns or questions about this, please contact me.

If your child subscribed to my newsletter, please unsubscribe him or her or contact me.

When it comes to the collection of personal information from children under the age of 18 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do NOT collect information from children under 18. If you feel I may have collected information from your child such as a name and email address or something else please contact me immediately so that I can have that information removed. 

Sensitive Information: 

Although it is never requested, at no time should you submit sensitive personal information to the Website. This includes your social security number, information regarding race or ethnic origin, political opinions, religious beliefs, health information, criminal background, or trade union memberships.

Newsletters: 

On the Website, you may subscribe to our newsletter, which may be used to advertise all my new content and any special announcements. All newsletters sent may contain tracking pixels. The pixel is embedded in emails and allows an analysis of the success of online marketing campaigns. Because of these tracking pixels, we may see if and when you open an email and which links within the email you click. Also, this allows the Website to adapt the content of future newsletters to the interests of the user. This behavior will not be passed on to third parties.

Giveaways

Occasionally I may use a third party application called “Gleam” to run a giveaway campaign. These campaigns are optional and you may opt in to these by choice. Affiliate Program Participation

The Website engages in affiliate marketing, which is done by embedding tracking links into the Website. If you click on a link for an affiliate partnership, a cookie will be placed on your browser to track any sales for purposes of commissions.
